The Committee on Rules, having had under consideration
House Resolution 648, by a record vote of 8 to 3, report the
same to the House with the recommendation that the resolution
be adopted.

SUMMARY OF PROVISIONS OF THE RESOLUTION

The resolution provides for consideration of H.R. 5652, the
Sequester Replacement Reconciliation Act of 2012, under a
closed rule. The resolution provides two hours of debate
equally divided and controlled by the chair and ranking
minority member of the Committee on the Budget. The resolution
waives all points of order against consideration of the bill.
The resolution provides that an amendment in the nature of a
substitute consisting of the text of Rules Committee Print 112-
21 shall be considered as adopted and the bill, as amended,
shall be considered as read. The resolution waives all points
of order against provisions in the bill, as amended. Finally,
the resolution provides one motion to recommit with or without
instructions.

EXPLANATION OF WAIVERS

If the bill is considered in the House on Thursday, May 10,
2012, the waiver of all points of order against consideration
of the bill will include a waiver of clause 4(a) of rule XIII,
requiring the three-day layover of the committee report. While
the text of the reconciliation bill and Rules Committee Print
112-21 have both been available since Monday, May 7, 2012, the
Committee on the Budget was not able to file its report until
receipt of Minority Views provided for under the rules of the
House.
The waiver of all points of order against consideration of
the bill also includes a waiver of Section 311(a) of the
Congressional Budget Act, which prohibits consideration of
legislation that would cause revenues to be less than the level
of total revenues for the first fiscal year for which
allocations are provided.
The waiver of all points of order against provisions in the
bill, as amended, includes a waiver of clause 5(a) of rule XXI,
which provides that a bill or joint resolution carrying a tax
or tariff measure may not be reported by a committee not having
jurisdiction to report tax or tariff measures.

Motion by Mr. McGovern to make in order and provide the
appropriate waivers for amendment #2, offered by Rep. Van
Hollen (MD), which would replace the entire sequester for
2013--which would cause deep cuts to important domestic
priorities and defense, and even cut Medicare--with savings
from specific policies that reflect a balanced approach to
deficit reduction. Would protect our most vulnerable citizens,
asks those earning over $1 million per year to contribute more,
eliminates Agriculture direct payments, and cuts subsidies for
Big Oil. Would also reform the flood insurance program.

Motion by Mr. Hastings of Florida to make in order and
provide the appropriate waivers for amendment #1, the
Congressional Progressive Caucus Substitute, offered by Rep.
Honda (CA), Rep. Ellison (MN), and Rep. Grijalva (AZ), which
would replace the Sequester Replacement Reconciliation Act of
2012 with alternative deficit reduction proposals including:
adoption of the ``Buffett Rule,'' repeal of the unneeded
corporate tax expenditure, and closing loopholes that allow
businesses to dodge their true tax liability. Defeated: 3-8
