Dear Mr. Speaker: I ask the Congress to consider the enclosed Fiscal Year (FY) 2015 Budget amendments for the Department of Defense (DOD) and the Department of State and Other International Programs (State/OIP) to fund Overseas Contingency Operations (OCO). These amendments would provide $58.6 billion for DOD OCO activities, which is $20.9 billion less than the $79.4 billion placeholder for DOD OCO in the FY 2015 Budget. It would also provide $1.4 billion for State/OIP OCO activities, which is in addition to the $5.9 billion for State/OIP included in the FY 2015 Budget. Overall, these amendments would decrease the total OCO funding requested for FY 2015 by $19.5 billion. Final decisions about the number and activities of U.S. forces in Afghanistan after December 2014 had not yet been made at the time the FY 2015 Budget was submitted. As a result, the Budget included a placeholder for DOD FY 2015 OCO funding equivalent to the amount requested in the FY 2014 Budget. The Administration noted in the FY 2015 Budget that after determining required force levels in Afghanistan, a Budget amendment updating the OCO request would be submitted to the Congress. The enclosed amendments include the necessary updates to the OCO request in order to fund military operations in Afghanistan, a significant portion of the U.S. military presence around the Middle East, the Administration's proposed Counterterrorism Partnerships Fund and European Reassurance Initiative, and State/OIP peacekeeping costs in the Central African Republic. Submitted for your consideration are amendments to your Fiscal Year (FY) 2015 Overseas Contingency Operations (OCO) request for the Department of Defense (DOD) and the Department of State and Other International Programs (State/OIP). Military operations in Afghanistan, as well as activities that support Operation Enduring Freedom (OEF), related follow-on activities, and other critical missions in the region, constitute the majority of the DOD OCO request. The request also includes funding for both DOD and State/OIP to implement the Counterterrorism Partnerships Fund (CTPF) and the European Reassurance Initiative (ERI), and additional funding for State/ OIP peacekeeping costs in the Central African Republic (CAR). Because final decisions about the number and activities of U.S. forces in Afghanistan after December 2014 had not yet been made when the FY 2015 Budget was submitted, the Budget included $5.9 billion in OCO funding for State/OIP and a placeholder of $79.4 billion for DOD. This package submits for your consideration the complete and updated FY 2015 request for DOD OCO funding, totaling $58.6 billion, as well as an increase of $1.4 billion for State/OIP OCO funding. Overall, these amendments decrease by $19.5 billion the total amount of OCO funding requested for FY 2015. The United States' goals in Afghanistan beyond 2014 are to continue to support the Afghan National Security Forces, support economic development and governance efforts, and pursue U.S. counterterrorism goals against al Qaeda and its affiliated groups. As you announced in May, the United States will conclude combat operations in Afghanistan by the end of this calendar year. The United States will draw down to approximately 9,800 U.S. servicemembers in Afghanistan by early 2015, which, together with NATO allies and other partners, will allow the United States to continue advising key Afghan forces and to sustain counterterrorism operations. By the end of 2015 the United States will have reduced that presence by roughly half and consolidated its military and diplomatic presence to Kabul and Bagram Airfield. By the end of 2016, DOD will draw down to a more conventional embassy-based security assistance presence in Kabul. In support of OEF and related follow-on activities, DOD OCO funding would support several key efforts, including:Lconcluding the combat mission in Afghanistan at the end of 2014 and positioning U.S. military and intelligence forces in Afghanistan for their post-2014 mission; Ldrawing down to approximately 9,800 U.S. servicemembers in the country by early 2015 from an average of 38,000 in FY 2014; Lcontinuing to support the Afghan National Security Forces (ANSF) as they assume full responsibility for security in Afghanistan after December 2014; Lsustaining the fight against transnational terrorists who seek to undermine the United States and its allies; Lproviding warfighters with the intelligence, surveillance, and reconnaissance (ISR) support that has proven essential for mission success in Afghanistan and around the region; Lproviding support to Coalition allies in Afghanistan and the surrounding region; Ldisposing of unexploded ordnance in Afghanistan and continuing to support Coalition and partner efforts to counter improvised explosive devices; Lreturning thousands of cargo containers and pieces of equipment from Afghanistan to their home stations; Lreplenishing or replacing expended munitions and ammunition as well as combat-damaged equipment, including helicopters, ground vehicles, and unmanned aerial systems; and Lsupporting a portion of temporary Army and Marine Corps end strength that currently supports OEF, but will not be required under the defense strategy articulated in the 2014 Quadrennial Defense Review. Although the FY 2015 OCO request reflects a transition as the United States concludes combat operations in Afghanistan partway into the fiscal year, most costs will not decline precipitously. For example, DOD will still incur significant costs to transport personnel, supplies, and equipment back to their home stations. Funding to sustain the ANSF will continue to be needed to ensure that Afghan forces can provide sufficient security. There will be continued costs to repair and replace equipment and munitions as DOD resets the force over the next few years. The OCO funding would also continue to support DOD's strong forward presence in the broader Middle East region. The overall U.S. military posture in the region enables DOD to support OEF and other important missions, such as assuring our regional partners, deterring aggression, and working with our partners to counter terrorism. It includes advanced fighter aircraft, ISR assets, missile defense capabilities, rotational ground forces, a robust naval presence, and building partners' capacity. As the United States continues its transition from over a decade of fighting in the broader region to preparing for future challenges, military capabilities in the region will continue to evolve to meet new threats. The updated OCO request includes $5 billion for CTPF, split among DOD, State/OIP, and the Intelligence Community, with dedicated transfer accounts in both DOD and State/OIP designed to provide the flexibility and resources required to respond to emerging needs as terrorist threats continue to evolve. The CTPF would support a more sustainable and effective approach to combating terrorism that focuses on empowering and enabling partners facing terrorist threats. The DOD request of $4.0 billion would support a transitional effort to increase partner capacity-building, facilitate partner counterterrorism operations, enhance DOD's counterterrorism activities, and increase DOD's flexibility in responding to emergent crises. The State/OIP request of $1.0 billion would enable the Department to increase counterterrorism and stabilization efforts in areas such as the Middle East, North Africa and the Sahel, the Horn of Africa, and South and Central Asia; address underlying conditions conducive to terrorism; and address the broader counterterrorism challenge of the crisis in Syria and its destabilizing impact on the region. Both funds build primarily on existing authorities, but would provide the Federal Government with expanded flexibility and resources to respond more nimbly to evolving terrorist threats and further develop and invest in partnerships from South Asia to the Sahel. The OCO request also includes $1 billion for the ERI to provide temporary support to bolster the security of our NATO allies and partner states in Europe. These funds would enable the United States to increase military exercises, training, and presence in Europe, especially in Central and Eastern Europe, increase U.S. naval force deployments to the Black and Baltic Seas, enhance our preparedness to reinforce NATO allies through the prepositioning of equipment, improve infrastructure at training and logistics facilities, especially in Central and Eastern Europe, and strengthen the capacity of partner states in Europe to operate alongside the United States and NATO and to defend their security. Of the $1 billion requested, $925 million is for DOD and $75 million is for State/OIP's Foreign Military Financing account. The updated request includes an additional $278 million in State/OIP's Peacekeeping Response Mechanism account to fully fund the additional estimated costs resulting from the April 2014 decision by United Nations (UN) Security Council to authorize a new UN peacekeeping mission to deploy in the CAR. This decision was made after the Administration submitted its FY 2015 Budget. General provisions included in this request would provide necessary authorities to support military operations in the U.S. Central Command area of responsibility. As in each of the past five years, these include a request for $4 billion in OCO- specific transfer authority. Your FY 2015 Budget submitted in March 2014 estimated $47.1 billion in FY 2015 outlays from the FY 2015 DOD OCO placeholder. Based on the updated request submitted in this package, FY 2015 DOD OCO outlays from new budget authority would be $33.8 billion. In addition, the updated request increases estimated FY 2015 State/OIP OCO outlays by $472 million. The FY 2015 Budget also reproposes a $450 billion multi- year cap on Government-wide OCO funding over the FY 2013 to FY 2021 period. In FY 2014, enacted funding designated as OCO is $91.9 billion across DOD, State/OIP, and the Department of Homeland Security. With this update, the FY 2015 Budget proposes a total of $65.8 billion in OCO funding for DOD and State/OIP, leaving a total of $199.2 billion remaining under the proposed cap for the years FY 2016 to FY 2021, or an average of $33.2 billion per year. Recommendation I reviewed these amendments and am satisfied that they are necessary at this time. The indefinite appropriation for the Medicare-Eligible Retiree Health Fund Contribution, Army would be increased by $45.9 million, as provided in the Ronald W. Reagan National Defense Authorization Act for Fiscal Year 2005 (P.L. 108-375), bringing the total indefinite appropriation for that account to $1.841 billion. This assumes enactment of the TRICARE fee proposals included in the FY 2015 Budget. This amendment would provide $4.0 billion for the Department of Defense (DOD) portion of the Counterterrorism Partnerships Fund (CTPF) announced by the President at West Point on May 28, 2014. DOD funds made available for the CTPF would enable the United States to enhance counterterrorism and crisis response activities undertaken by the U.S. military and provide enabling support to partners on the front lines against terrorism. CTPF funds will be used to support counterterrorism capacity-building efforts and/or combined counterterrorism operations in areas such as the Middle East, North Africa and the Sahel, the Horn of Africa, and South and Central Asia. In addition, CTPF funds will be used to expand or enhance U.S. capabilities and capacity needed to support counterterrorism goals (e.g., additional intelligence, surveillance, and reconnaissance capacity) and will allow DOD to respond more quickly and effectively to emergent crises related to counterterrorism. The CTPF builds primarily on existing authorities, but provides the Federal Government with expanded flexibility and resources to respond more nimbly to evolving terrorist threats and to further develop and invest in partnerships from South Asia to the Sahel in support of a sustainable and effective counterterrorism strategy. In addition, appropriating CTPF funding in a transfer account will provide the flexibility needed to effectively respond to diffuse terrorist networks and a rapidly changing security environment. Specific allocations of CTPF funding will be subject to congressional notification requirements as well as an interagency policy process jointly led by the National Security Council and the Office of Management and Budget in order to ensure integrated planning and comprehensive oversight of CTPF funds. The CTPF will also include the Syria Regional Stabilization Initiative (RSI). Funding under the RSI will build the capacity of the Syrian opposition and of neighboring countries including Jordan, Lebanon, Turkey, and Iraq to manage the growing spillover effects of the Syrian conflict. The Administration will leverage existing security cooperation and assistance programs, expand training and related infrastructure, and tailor support packages to meet identified regional needs for areas contending with refugees and other destabilizing effects from the Syrian conflict. The Administration has included a proposed authority to provide defense articles and services to vetted elements of the Syrian armed opposition to help defend the Syrian people, stabilize areas under opposition control and facilitate the provision of essential services, counter terrorist threats, and promote conditions for a negotiated settlement. The RSI will make investments in the region now that can help build resilience in communities and strengthen internal and border security capabilities for the Syrian people and Syria's neighbors as they confront growing threats. Funds made available for the ERI will enable the United States to increase military exercises, training, and presence in Europe, especially Central and Eastern Europe; increase U.S. naval force deployments to the Black and Baltic Seas; enhance our preparedness to reinforce NATO allies through the prepositioning of equipment; improve infrastructure at training and logistics facilities, especially in Central and Eastern Europe; and strengthen the capacity of partner states in Europe to operate alongside the United States and NATO and to defend their security. Building on existing authorities, appropriating ERI funding in a transfer account will provide flexibility and responsiveness to the evolving concerns of our allies and partners and allow time for the long planning horizons needed for exercises and deployments in a fluid security situation. Notwithstanding any other provision of law, funds made available by this Act and designated for Overseas Contingency Operations/Global War on Terrorism pursuant to section 251(b)(2)(A) of the Balanced Budget and Emergency Deficit Control Act of 1985, as amended, are in addition to amounts appropriated or otherwise made available for the Department of Defense for fiscal year 2015. Sec. 9002. Upon the determination of the Secretary of Defense that such action is necessary in the national interest, the Secretary may, with the approval of the Office of Management and Budget, transfer up to $4,000,000,000 between the appropriations or funds made available to the Department of Defense and designated for Overseas Contingency Operations/ Global War on Terrorism pursuant to section 251(b)(2)(A) of the Balanced Budget and Emergency Deficit Control Act of 1985, as amended: Provided, That the Secretary shall notify the Congress promptly of each transfer made pursuant to the authority in this section: Provided further, That the authority provided in this section is in addition to any other transfer authority available to the Department of Defense and is subject to the same terms and conditions as the authority provided in section 8003 of this Act. Sec. 9003. Supervision and administration costs and costs for design during construction associated with a construction project funded with appropriations available for operation and maintenance or the ``Afghanistan Security Forces Fund'' provided in this Act and executed in direct support of overseas contingency operations in Afghanistan may be obligated at the time a construction contract is awarded: Provided, That for the purpose of this section, supervision and administration costs and costs for design during construction include all in-house Government costs. Sec. 9004. From funds made available by this Act and designated for Overseas Contingency Operations/Global War on Terrorism pursuant to section 251(b)(2)(A) of the Balanced Budget and Emergency Deficit Control Act of 1985, as amended, the Secretary of Defense may purchase for use by military and civilian employees of the Department of Defense in the U.S. Central Command area of responsibility: (a) passenger motor vehicles up to a limit of $75,000 per vehicle; and (b) heavy and light armored vehicles for the physical security of personnel or for force protection purposes up to a limit of $450,000 per vehicle, notwithstanding price or other limitations applicable to the purchase of passenger carrying vehicles. Sec. 9005. Not to exceed $15,000,000 of the amount appropriated by this Act and designated for Overseas Contingency Operations/Global War on Terrorism pursuant to section 251(b)(2)(A) of the Balanced Budget and Emergency Deficit Control Act of 1985, as amended, under the heading ``Operation and Maintenance, Army'' may be used, notwithstanding any other provision of law, to fund the Commander's Emergency Response Program (CERP), for the purpose of enabling military commanders in Afghanistan to respond to urgent, small-scale, humanitarian relief and reconstruction requirements within their areas of responsibility: Provided, That each project (including any ancillary or related elements in connection with such project) executed under this authority shall not exceed $10,000,000: Provided further, That not later than 45 days after the end of each fiscal year quarter, the Secretary of Defense shall submit to the congressional defense committees a report regarding the source of funds and the allocation and use of funds during that quarter that were made available pursuant to the authority provided in this section or under any other provision of law for the purposes described herein. Sec. 9006. Funds available to the Department of Defense for operation and maintenance may be used, notwithstanding any other provision of law, to provide supplies, services, transportation, including airlift and sealift, and other logistical support to coalition forces supporting military and stability operations in Afghanistan: Provided, That the Secretary of Defense shall provide quarterly reports to the congressional defense committees regarding support provided under this section. Sec. 9007. None of the funds made available in this Act may be used in contravention of the following laws enacted or regulations promulgated to implement the United Nations Convention Against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment (done at New York on December 10, 1984): (1) Section 2340A of title 18, United States Code. (2) Section 2242 of the Foreign Affairs Reform and Restructuring Act of 1998 (division G of Public Law 105-277; 112 Stat. 2681-822; 8 U.S.C. 1231 note) and regulations prescribed thereto, including regulations under part 208 of title 8. Code of Federal Regulations, and part 95 of title 22, Code of Federal Regulations. (3) Sections 1002 and 1003 of the Department of Defense, Emergency Supplemental Appropriations to Address Hurricanes in the Gulf of Mexico, and Pandemic Influenza Act, 2006 (Public Law 109-148). Sec. 9008. Funds made available to the Department of Defense by this Act and designated for Overseas Contingency Operations/Global War on Terrorism pursuant to section 251(b)(2)(A) of the Balanced Budget and Emergency Deficit Control Act of 1985, as amended, for operation and maintenance may be used to purchase items having an investment unit cost of not more than $250,000: Provided, That, upon determination by the Secretary of Defense that such action is necessary to meet the operational requirements of a Commander of a Combatant Command engaged in contingency operations overseas such funds may be used to purchase items having an investment item unit cost of not more than $500,000. Sec. 9009. From funds made available to the Department of Defense by this Act and designated for Overseas Contingency Operations/Global War on Terrorism pursuant to section 251(b)(2)(A) of the Balanced Budget and Emergency Deficit Control Act of 1985, as amended, under the heading ``Operation and Maintenance, Air Force'', up to $140,000,000 may be used by the Secretary of Defense, notwithstanding, any other provision of law, to support United States Government transition activities in Iraq by funding the operations and activities of the Office of Security Cooperation in Iraq and security assistance teams, including life support, transportation and personal security, facilities renovation and construction, and site close out activities prior to returning sites to the Government of Iraq: Provided, That, to the extent authorized under the National Defense Authorization Act for Fiscal Year 2015, the operations and activities that may be carried out by the Office of Security Cooperation in Iraq may, with the concurrence of the Secretary of State, include non-operational training activities in support of Iraqi Ministry of Defense and Counter Terrorism Service personnel in an institutional environment to address capability gaps, integrate processes relating to intelligence, air sovereignty, combined arms, logistics and maintenance, and to manage and integrate defense- related institutions. Sec. 9010. Notwithstanding any other provision of law, up to $250,000,000 of funds made available to the Department of Defense by this Act and designated for Overseas Contingency Operations/Global War on Terrorism pursuant to section 251(b)(2)(A) of the Balanced Budget and Emergency Deficit Control Act of 1985, as amended, for operation and maintenance may be used to conduct surface and subsurface clearance of unexploded ordnance at training ranges previously used by the Armed Forces of the United States in Afghanistan: Provided, That the term ``unexploded ordnance'' has the meaning given that term in section 101(e)(5) of title 10, United States Code: Provided further, That the surface and subsurface clearance of unexploded ordnance under this section may only take place on training ranges managed and operated by the Armed Forces of the United States that have not been transferred to the Government of the Islamic Republic of Afghanistan for use by its security forces. Sec. 9011. Notwithstanding any other provision of law, the Secretary of Defense is authorized, with the concurrence of the Secretary of State, to provide assistance, including the provision of defense articles and defense services, to appropriately vetted elements of the Syrian opposition and other appropriately vetted Syrian groups or individuals for the following purposes: (1) Defending the Syrian people from attacks by the Syrian regime, facilitating the provision of essential services, and stabilizing territory controlled by the opposition; (2) Defending the United States, its friends and allies, and the Syrian people from the threats posed by terrorists in Syria; and (3) Promoting the conditions for a negotiated settlement to end the conflict in Syria: Provided, That the Secretary of Defense may accept contributions from foreign governments to provide assistance under this section: Provided further, That any funds so accepted by the Secretary may be credited to the account from which funds are made available for the provision of such assistance, and may be used for such purpose until expended: Provided further, That any amounts provided pursuant to the first and second provisos are designated by the Congress for Overseas Contingency Operations/ Global War on Terrorism pursuant to section 251(b)(2)(A) of the Balanced Budget and Emergency Deficit Control Act of 1985, as amended: Provided further That any amounts provided pursuant to the first and second provisos shall be available only if the President designates such amounts for Overseas Contingency Operations/Global War on Terrorism pursuant to section 251(b)(2)(A): Provided further, That the authority to provide assistance under this section shall terminate on December 31, 2018. (CANCELLATION) Sec. 9012. (a) Of the funds appropriated in Department of Defense Appropriations Acts, the following funds are hereby permanently cancelled from the following account and program in the specified amount: Aircraft Procurement, Army, 2014/2016: Kiowa Warrior WRA, $117,000,000: (b) The amount in this section is designated by the Congress for Overseas Contingency Operations/Global War on Terrorism pursuant to section 251(b)(2)(A)(ii) of the Balanced Budget and Emergency Deficit Control Act of 1985, as amended. Such amount shall be cancelled only if the President designates such amount for Overseas Contingency Operations/Global War on Terrorism pursuant to section 251(b)(2)(A). These amendments would provide necessary authorities to support the Overseas Contingency Operations request. DEPARTMENT OF STATE AND OTHER INTERNATIONAL PROGRAMS International Organizations and Conferences PEACEKEEPING RESPONSE MECHANISM (OVERSEAS CONTINGENCY OPERATIONS) FY 2015 Budget Appendix Page: 842 FY 2015 Pending Request: $150,000,000 Proposed Amendment: $278,000,000 Revised Request: $428,000,000 (In the appropriations language under the above subheading, delete ``$150,000,000'' and substitute $428,000,000.) This amendment would provide $1.0 billion for the Department of State/OIP's portion of the Counterterrorism Partnerships Fund (CTPF) announced by the President at West Point on May 28, 2014. Funds made available for the CTPF would enable the United States to enhance counterterrorism and crisis response activities and provide enabling support to partners on the front lines against terrorism. CTPF funds will be used to support counterterrorism capacity-building efforts in areas such as the Middle East, North Africa and the Sahel, the Horn of Africa, and South and Central Asia. The CTPF will also include the Syria Regional Stabilization Initiative (RSI). Funding under the RSI will build the capacity of the Syrian opposition and of neighboring countries including Jordan, Lebanon, Turkey, and Iraq to manage the growing spillover effects of the Syrian conflict. The Administration will leverage existing security cooperation and assistance programs, expand training and related infrastructure, and tailor support packages to meet identified regional needs for areas contending with refugees and other destabilizing effects from the Syrian conflict. The RSI will make investments in the region now that can help build resilience in communities and strengthen internal and border security capabilities for the Syrian people and Syria's neighbors as they confront growing threats. The CTPF builds on existing authorities, but provides the Federal Government with expanded flexibility and resources to respond more nimbly to evolving terrorist threats and to further develop and invest in partnerships from South Asia to the Sahel in support of a sustainable and effective counterterrorism strategy. In addition, appropriating CTPF funding in a transfer account will provide the flexibility needed to effectively respond to diffuse terrorist networks and a rapidly changing security environment. Specific allocations of CTPF funding will be subject to congressional notification requirements as well as an interagency policy process jointly led by the National Security Council and the Office of Management and Budget in order to ensure integrated planning and comprehensive oversight of CTPF funds.
