PROVIDING FOR CONSIDERATION OF THE BILL (H.R. 1216) TO AMEND THE PUBLIC 
HEALTH SERVICE ACT TO CONVERT FUNDING FOR GRADUATE MEDICAL EDUCATION IN 
  QUALIFIED TEACHING HEALTH CENTERS FROM DIRECT APPROPRIATIONS TO AN 
  AUTHORIZATION OF APPROPRIATIONS; PROVIDING FOR CONSIDERATION OF THE 
 BILL (H.R. 1540) TO AUTHORIZE APPROPRIATIONS FOR FISCAL YEAR 2012 FOR 
   MILITARY ACTIVITIES OF THE DEPARTMENT OF DEFENSE AND FOR MILITARY 
CONSTRUCTION, TO PRESCRIBE MILITARY PERSONNEL STRENGTHS FOR FISCAL YEAR 
2012, AND FOR OTHER PURPOSES; AND WAIVING A REQUIREMENT OF CLAUSE 6(a) 
   OF RULE XIII WITH RESPECT TO CONSIDERATION OF CERTAIN RESOLUTIONS

    The Committee on Rules, having had under consideration 
House Resolution 269, by a nonrecord vote, report the same to 
the House with the recommendation that the resolution be 
adopted.

                SUMMARY OF PROVISIONS OF THE RESOLUTION

    The resolution provides for consideration of H.R. 1216, to 
amend the Public Health Service Act to convert funding for 
graduate medical education in qualified teaching health centers 
from direct appropriations to an authorization of 
appropriations, under a modified open rule. The resolution 
provides one hour of general debate equally divided and 
controlled by the chair and ranking minority member of the 
Committee on Energy and Commerce. The resolution waives all 
points of order against consideration of H.R. 1216. The 
resolution provides that after general debate H.R. 1216 shall 
be considered for amendment under the five-minute rule and 
shall be considered as read. The resolution waives all points 
of order against provisions in H.R. 1216. The resolution makes 
in order only those amendments that are received for printing 
in the Congressional Record dated May 23, 2011, and pro forma 
amendments for the purpose of debate. The resolution provides 
that each amendment received for printing in the Congressional 
Record may be offered only by the Member who submitted it for 
printing or their designee, and that each such amendment shall 
be considered as read. The resolution provides one motion to 
recommit H.R. 1216 with or without instructions.
    Additionally, the resolution provides for consideration of 
H.R. 1540, the National Defense Authorization Act for Fiscal 
Year 2012. The resolution provides for one hour of general 
debate on H.R. 1540 equally divided and controlled by the chair 
and ranking minority member of the Committee on Armed Services. 
The resolution waives all points of order against consideration 
of H.R. 1540. The resolution provides that after general debate 
the Committee of the Whole shall rise without motion and that 
no further consideration of the bill shall occur except 
pursuant to a subsequent order of the House.
    Lastly, the resolution waives clause 6(a) of rule XIII 
(requiring a two-thirds vote to consider a rule on the same day 
it is reported from the Rules Committee) against any resolution 
reported from the Rules Committee providing for consideration 
or disposition of a measure addressing expiring provisions of 
the USA PATRIOT Improvement and Reauthorization Act of 2005, 
through the legislative day of May 27, 2011.

                         EXPLANATION OF WAIVERS

    Although the resolution waives all points of order against 
consideration of H.R. 1216, the Committee is not aware of any 
points of order against consideration of the bill. The waiver 
is prophylactic.

    The resolution waives all points of order against 
consideration of H.R. 1540. The waiver includes a waiver of:
     Clause 3(e) of rule XIII, which requires the 
inclusion of a comparative print for a bill or joint resolution 
proposing to repeal or amend a statute or part thereof.
     Clause 4(a) of rule XIII, which prohibits 
consideration of legislation in the House until the third 
calendar day on which each report of a committee on that 
measure or matter has been available to Members, Delegates and 
the Resident Commissioner. While the Committee on Armed 
Services filed its report on May 17, 2011, the Committee 
requested authority to file a supplemental report, which 
includes a more comprehensive cost estimate from the 
Congressional Budget Office. The revised cost estimate was made 
publicly available on May 20, 2011, and the Committee on Armed 
Services filed its supplemental report on May 23, 2011.
     Section 303 of the Congressional Budget Act of 
1974, which prohibits the consideration of legislation 
providing new budget authority, changes in revenues, changes in 
public debt, new entitlement authority, or new credit authority 
for a fiscal year until the budget resolution for that year has 
been agreed to. While the House has adopted H. Con. Res. 34, 
the Senate has failed to act on a budget resolution.
