      PROVIDING FOR CONSIDERATION OF THE BILL (H.R. 2997) MAKING 
   APPROPRIATIONS FOR AGRICULTURE, RURAL DEVELOPMENT, FOOD AND DRUG 
   ADMINISTRATION, AND RELATED AGENCIES PROGRAMS FOR THE FISCAL YEAR 
           ENDING SEPTEMBER 30, 2010, AND FOR OTHER PURPOSES

   Mr. McGovern, from the Committee on Rules, submitted the following

                       [To accompany H. Res. 609]

    The Committee on Rules, having had under consideration 
House Resolution 609, by a non-record vote, report the same to 
the House with the recommendation that the resolution be 
adopted.

                SUMMARY OF PROVISIONS OF THE RESOLUTION

    The resolution provides for consideration of H.R. 2997, the 
Agriculture, Rural Development, Food and Drug Administration, 
and Related Agencies Appropriations Act, 2010, under a 
structured rule. The resolution provides one hour of general 
debate equally divided and controlled by the chair and ranking 
minority member of the Committee on Appropriations. The 
resolution waives all points of order against consideration of 
the bill except for clauses 9 and 10 of rule XXI. The 
resolution waives all points of order against provisions in the 
bill for failure to comply with clause 2 of rule XXI.
    The resolution makes in order the following amendments: (1) 
the amendment printed in part A of the report of the Committee 
on Rules accompanying this resolution; (2) the amendments 
printed in part B of the report of the Committee on Rules; (3) 
not to exceed one of the amendments printed in part C of the 
report of the Committee on Rules if offered by Representative 
Campbell of California or his designee; (4) not to exceed three 
of the amendments printed in part D of the report of the 
Committee on Rules if offered by Representative Flake of 
Arizona or his designee; and (5) not to exceed one of the 
amendments printed in part E of the report of the Committee on 
Rules if offered by Representative Hensarling of Texas or his 
designee. The resolution provides that each such amendment 
shall be considered as read, shall be debatable for 10 minutes 
equally divided and controlled by the proponent and an 
opponent, and shall not be subject to a demand for division of 
the question in the House or in the Committee of the Whole. All 
points of order against such amendments are waived except those 
arising under clause 9 or 10 of rule XXI. The resolution also 
provides that the amendments printed in part B through E of the 
report may be offered only at the appropriate point in the 
reading.
    The resolution provides that for those amendments reported 
from the Committee of the Whole, the question of their adoption 
shall be put to the House en gros and without demand for 
division of the question. The resolution provides one motion to 
recommit with or without instructions.
    The resolution provides that after consideration of the 
bill for amendment, the chair and ranking minority member of 
the Committee on Appropriations or their designees each may 
offer one pro forma amendment to the bill for the purpose of 
debate, which shall be controlled by the proponent. The 
resolution provides that the Chair may entertain a motion that 
the Committee rise only if offered by the chair of the 
Committee on Appropriations or his designee and that the Chair 
may not entertain a motion to strike out the enacting words of 
the bill (as described in clause 9 of rule XVIII). Finally, the 
resolution provides that during consideration of H.R. 2997, the 
Chair may reduce to two minutes the minimum time for electronic 
voting under clause 6 of rule XVIII and clauses 8 and 9 of rule 
XX.

                         EXPLANATION OF WAIVERS

    The waiver of all points of order against consideration of 
the bill (except for clauses 9 and 10 of rule XXI) includes a 
waiver of clause 4(c) of rule XIII, requiring the three-day 
availability of printed hearings on a general appropriation 
bill.
    The waiver of all points of order against provisions in the 
bill includes a waiver of clause 2 of rule XXI, prohibiting 
unauthorized appropriations or legislative provisions in an 
appropriations bill.

           SUMMARY OF AMENDMENT IN PART A TO BE MADE IN ORDER

    1. DeLauro (CT): Would increase funding for the 
Agricultural Research Service salaries and expenses account by 
$2 million to go toward Colony Collapse Disorder and pollinator 
decline research, offset by a $1 million reduction in the 
Office of the Chief Information Officer and a $1 million 
reduction in Departmental Administration. Would increase 
funding for the National Institute of Food and Agriculture 
competitive grants by $3,000,000 to be used for Colony Collapse 
Disorder (CCD) and pollinator decline research, and offsets the 
increase by a reduction in funding for the Departmental 
Administration. Would increase funding for the Office of 
Inspector General at USDA by $500,000 to determine whether the 
USDA Organic certification program ensures that the most 
rigorous standards for certification are honored, and to 
investigate whether non-organic substances inappropriately 
remain allowed in small amounts in USDA certified products 
after organic alternatives have been discovered. The increase 
is offset by a decrease of the same amount in funding for the 
Agriculture Buildings and Facilities, General Services 
Administration account. Would increase the appropriation for 
the Higher Education Multicultural Scholars Program by $519,000 
to a total of $1.5 million. The amount would be offset by 
decreasing appropriations for ``administrative expenses 
necessary to carry out direct and guaranteed loan programs'' 
within the Agricultural Credit Insurance Fund Program Account. 
Appropriates tobacco product user fees authorized under the 
Family Smoking Prevention and Tobacco Control Act (Public Law 
111-31). Would fund the Methamphetamine Inhibitor Grant Program 
created in the 2008 Farm Bill at $2,000,000. Offsets the 
increase in spending by reducing spending on Rural Development 
Salaries and Expenses. Would prohibit the use of funds for 
first class travel for employees of agencies funded by the 
bill, in contravention of Federal regulations.

          SUMMARY OF AMENDMENTS IN PART B TO BE MADE IN ORDER

    1. Blackburn (TN): Would make an across-the-board cut of 5 
percent to all discretionary funding accounts in the bill.
    2. Brady, Kevin (TX): Would transfer $50,000 from the Chief 
Economist to the Economic Research Service.

equal the FY09 level.
    4. Capito (WV): Would transfer $10,038,000 in the bill from 
the USDA Office of the Chief Information Officer (OCIO) to the 
Rural Utilities Service Rural Water and Waste Disposal Program 
(restoring the latter to FY09 appropriation levels).
    5. Fortenberry (NE): Would increase funding for Rural 
Energy for America by $2 million, offset by a $2 million 
reduction for the Office of the Chief Information Officer.
    6. Garrett (NJ): Would increase funding for the Natural 
Resources Conservation Service (NRCS) Conservation Operation 
Account by $5,000,000 and offset the increase by decreasing 
funding for Farm Service Agency (FSA) Salaries and Expenses by 
the same amount.
    7. Kingston (GA): Would prohibit funds from being used to 
administer or pay the salary of personnel who administer any 
broadband loans or loan guarantees on or before September 15, 
2010.

                    SUMMARY OF AMENDMENTS IN PART C

    1. Campbell (CA): Would prohibit certain funds in the bill 
from being used for the Center for One Medicine in Illinois and 
reduces funds under the heading ``National Institute of Food 
and Agriculture--Research and Education Activities'' by the 
amount that was to have been spent on the Center for One

    2. Campbell (CA): Would prohibit certain funds in the bill 
from being used for Specialty Crops in Indiana and reduces

spent on the Agriculture Energy Innovation Center in Georgia.
    5. Flake, Jeff (AZ): Would prohibit certain funds in the 
bill from being used for the Dairy Education Project in Iowa

research in Ohio and reduce the overall appropriation in the 
bill by $1.38 million.

best practices in agricultural waste management in California 
and reduce the overall appropriation of the bill by $300,000.
    4. Hensarling (TX): Would bar funding for agricultural 
diversification research in Hawaii and reduce the appropriation 
in the bill by $153,000.
    5. Hensarling (TX): Would prohibit certain funds in the 
bill from being used for Cranberry/Blueberry disease and 
breeding research in New Jersey and reduces funds under the 
heading ``National Institute of Food and Agriculture--Research
