FINDINGS AND CONCLUSIONS In accordance with Rule 18(e)(2) of the Committee on Standards of Official Conduct (Standards Committee), the Standards Committee hereby submits the following report to the House of Representatives. On April 20, 2010, the Standards Committee convened for the purpose of considering misdemeanor charges issued by Montana's office of Fish, Wildlife & Parks against Randy Vogel, an employee of the House, on March 3, 2010, for the alleged illegal killing of a spike bull elk during closed hunting season and related charges. The alleged criminal acts occurred on November 18 and 19, 2009, prior to Mr. Vogel's employment with the House, which began on March 1, 2010. On March 16, 2010, Mr. Vogel pleaded not guilty to the state charges, and it is anticipated that a trial date will be set in the near future. Mr. Vogel requested leave without pay status from his employment with the House until this matter is resolved. The Standards Committee voted against empanelling an investigative subcommittee regarding this matter. A state trial will occur soon to address the merits of the criminal charges against Mr. Vogel, which occurred prior to his employment with the House, and which he disputes. The Standards Committee has determined not to initiate review at this time by an investigative subcommittee in this matter in light of these circumstances.\1\ --------------------------------------------------------------------------- \1\The Standards Committee has jurisdiction over the conduct of Members, officers, and employees of the House.
