The amendment is as follows: Strike all after the enacting clause and insert the following: SECTION 1. SHORT TITLE. This Act may be cited as the ``Gateway Solidarity Act''. SEC. 2. ILLUMINATION OF THE GATEWAY ARCH IN SUPPORT OF UKRAINE. To show support and solidarity with the Ukrainian people, the Secretary of the Interior shall illuminate the Gateway Arch in St. Louis, Missouri, by blue and yellow lights-- (A) in 2022, within 15 days following enactment of this act, for no fewer than 5 consecutive days; and (B) annually on August 24, in recognition of Ukrainian Independence Day, until the President reports to Congress that the government of the Russian Federation has ceased its destabilizing activities with respect to the sovereignty and territorial integrity of Ukraine. PURPOSE OF THE BILL The purpose of H.R. 7002 is to authorize and require the Secretary of the Interior to illuminate Gateway Arch, a feature of Gateway Arch National Park in St. Louis, Missouri, by blue and yellow lights as a symbol of solidarity with the Ukrainian people during the Russia-Ukraine war. BACKGROUND AND NEED FOR LEGISLATION H.R. 7002 would direct the National Park Service (NPS) to illuminate the Gateway Arch by blue and yellow lights for a certain period designated by the Secretary of the Interior and annually until the government of the Russian Federation has ceased its destabilizing activities with respect to the sovereignty and territorial integrity of Ukraine. The Gateway Arch would be lit up in Ukrainian colors as a symbol of solidarity with the Ukrainian people during the Russia-Ukraine war. Gateway Arch National Park is a memorial to Thomas Jefferson's efforts for westward expansion and to the settlers who participated in that history. The park also commemorates the efforts of Dred Scott and is home to the Old Courthouse where he first sued for his freedom in the cases that culminated in Dred Scott v. Sandford. NPS does not typically support commemorative illuminations unless there is a clear connection to the mission and purpose of the unit where they are planned to occur. For example, the Gateway Arch was lit up in purple and gold to commemorate the 100th anniversary of women's constitutional right to vote. The Old Courthouse at Gateway Arch National Park has strong historical ties to the women's suffrage movement, as it is where Virginia Minor's voting rights case was first heard before reaching the U.S. Supreme Court in Minor v. Happersett. The Women's Suffrage Centennial Commission led the coordinated lighting event with the NPS as well as private landmark partners across the country. Given the strong historical connection and relationship to the purpose for which the park was established, NPS authorized the illumination through administrative discretion. In the case of the commemorating solidarity with Ukraine during the ongoing intervention and conflict, there is not a clear connection to Gateway Arch National Park, and NPS does not have the discretion to authorize the proposed illumination. H.R. 7002 would provide the authority to illuminate the feature at the direction of Congress. COMMITTEE ACTION H.R. 7002 was introduced on March 8, 2022, by Representative Ann Wagner (R-MO). The bill was referred solely to the Committee on Natural Resources, and within the Committee to the Subcommittee on National Parks, Forests, and Public Lands. On April 28, 2022, the Subcommittee held a hearing on the bill. On June 15, 2022, the Natural Resources Committee met to consider the bill. The Subcommittee was discharged by unanimous consent. Ranking Member Bruce Westerman (R-AR) offered an amendment designated Westerman #1. The amendment was agreed to by unanimous consent. The bill was adopted as amended and ordered favorably reported to the House of Representatives by unanimous consent. HEARINGS For the purposes of clause 3(c)(6) of House rule XIII, the following hearing was used to develop or consider this measure: hearing by the Subcommittee on National Parks, Forests, and Public Lands held on April 28, 2022. COMMITTEE OVERSIGHT FINDINGS AND RECOMMENDATIONS Regarding clause 2(b)(1) of rule X and clause 3(c)(1) of rule XIII of the Rules of the House of Representatives, the Committee on Natural Resources' oversight findings and recommendations are reflected in the body of this report. COMPLIANCE WITH HOUSE RULE XIII AND CONGRESSIONAL BUDGET ACT 1. Cost of Legislation and the Congressional Budget Act. The bill has been noticed for consideration by the House under suspension of the rules with the amendment that the Natural Resources Committee favorably reports herein, and without any further amendment. With respect to the requirements of clause 3(c)(2) and (3) of rule XIII of the Rules of the House of Representatives and sections 308(a) and 402 of the Congressional Budget Act of 1974, the Committee has requested from the Director of Congressional Budget Office a cost estimate for this bill and a statement as to whether this bill contains any new budget authority, spending authority, credit authority, or an increase or decrease in revenues or tax expenditures. The Committee has received the following partial response for the bill from the Director of the Congressional Budget Office, which reflects the text of the bill as reported and as noticed for suspension: Legislation Considered Under Suspension of the Rules The Majority Leader of the House of Representatives announces bills that will be considered under suspension of the rules in that chamber. Under suspension, floor debate is limited, all floor amendments are prohibited, points of order against the bill are waived, and final passage requires a two- thirds majority vote. At the request of the Majority Leader and the House Committee on the Budget, CBO estimates the effects of those bills on direct spending and revenues. CBO has limited time to review the legislation before consideration. Although it is possible in most cases to determine whether the legislation would affect direct spending or revenues, time may be insufficient to estimate the magnitude of those effects. If CBO has prepared estimates for similar or identical legislation, a more detailed assessment of budgetary effects, including effects on spending subject to appropriation, may be included. General Performance Goals and Objectives. EARMARK STATEMENT This bill does not contain any Congressional earmarks, limited tax benefits, or limited tariff benefits as defined under clause 9(e), 9(f), and 9(g) of rule XXI of the Rules of the House of Representatives. UNFUNDED MANDATES REFORM ACT STATEMENT An estimate of federal mandates prepared by the Director of the Congressional Budget Office pursuant to section 423 of the Unfunded Mandates Reform Act was not made available to the Committee in time for the filing of this report. The Chair of the Committee shall cause such estimate to be printed in the Congressional Record upon its receipt by the Committee. EXISTING PROGRAMS This bill does not establish or reauthorize a program of the federal government known to be duplicative of another program. APPLICABILITY TO LEGISLATIVE BRANCH The Committee finds that the legislation does not relate to the terms and conditions of employment or access to public services or accommodations within the meaning of section 102(b)(3) of the Congressional Accountability Act. PREEMPTION OF STATE, LOCAL, OR TRIBAL LAW Any preemptive effect of this bill over state, local, or tribal law is intended to be consistent with the bill's purposes and text and the Supremacy Clause of Article VI of the U.S. Constitution.
