PROVIDING FOR CONSIDERATION OF THE SENATE AMENDMENTS TO THE BILL (H.R. 
   3547) TO EXTEND THE APPLICATION OF CERTAIN SPACE LAUNCH LIABILITY 
 PROVISIONS THROUGH 2014; PROVIDING FOR PROCEEDINGS DURING THE PERIOD 
FROM JANUARY 17, 2014, THROUGH JANUARY 24, 2014; AND FOR OTHER PURPOSES

                Mr. Cole, from the Committee on Rules, 
                        submitted the following

                              R E P O R T

                       [To accompany H. Res. 458]

    The Committee on Rules, having had under consideration 
House Resolution 458, by a record vote of 9 to 4, report the 
same to the House with the recommendation that the resolution 
be adopted.

                SUMMARY OF PROVISIONS OF THE RESOLUTION

    Section 1 of the resolution provides for the consideration 
of the Senate amendments to H.R. 3547. The resolution makes in 
order a single motion offered by the chair of the Committee on 
Appropriations or his designee that the House concur in the 
Senate amendment to the title and concur in the Senate 
amendment to the text with an amendment inserting the text of 
Rules Committee Print 113-32 in lieu of the matter proposed to 
be inserted by the Senate. The resolution waives all points of 
order against consideration of the motion. The resolution 
provides that the Senate amendments and the motion shall be 
considered as read. The resolution provides one hour of debate 
on the motion equally divided and controlled by the chair and 
ranking minority member of the Committee on Appropriations.
    Section 2 of the resolution provides that upon adoption of 
the motion specified in Section 1 of the resolution, House 
Concurrent Resolution 74 shall be considered as adopted.
    Section 3 of the resolution provides that the chair of the 
Committee on Appropriations may insert in the Congressional 
Record not later than January 16, 2014, such material as he may 
deem explanatory of the Senate amendments and the motion 
specified in Section 1 of the resolution.
    Section 4 of the resolution provides that on any 
legislative day during the period from January 17, 2014, 
through January 24, 2014: the Journal of the proceedings of the 
previous day shall be considered as approved; and the Chair may 
at any time declare the House adjourned to meet at a date and 
time to be announced by the Chair in declaring the adjournment.
    Section 5 of the resolution provides that the Speaker may 
appoint Members to perform the duties of the Chair for the 
duration of the period addressed by section 4 of the 
resolution.

                         EXPLANATION OF WAIVERS

    The waiver of all points of order against consideration of 
the motion, includes the following:
    Clause 7 of rule XVI, requiring that no motion or 
proposition on a subject different from that under 
consideration shall be admitted under color of amendment. 
Provisions contained in Rules Committee Print 113-32 are not 
germane to the underlying measure.
    Clause 10 of rule XXI, prohibiting the consideration of a 
bill if it has the net effect of increasing mandatory spending 
over the five- or ten-year period. The waiver is necessary 
because of the cost associated with provisions addressing 
medically retired military personnel and survivor benefit plan 
recipients.
    Section 302(c) of the Congressional Budget Act, prohibiting 
consideration of an appropriation measure until that committee 
has made its sub-allocation under section 302(b).
    Section 306 of the Congressional Budget Act, prohibiting 
consideration of legislation within the jurisdiction of the 
Committee on the Budget unless referred to or reported by the 
Budget Committee.
